These terms govern your use of the DealGauge website, calculator, spreadsheets, guides, market reports, and research prompts (together, the "Tools"). By using the Tools or buying a product, you agree to these terms. If you do not agree, do not use the Tools.
The Tools are educational software for general information only. They are not investment, tax, legal, accounting, real estate, appraisal, or lending advice, and using them does not create any professional or advisory relationship. DealGauge is not a broker, dealer, lender, appraiser, financial advisor, or licensed agent. Before you buy, sell, finance, or make any decision about a property, verify every figure against primary local sources and consult a qualified professional.
Every output the Tools produce is an estimate based on the assumptions you enter and on third-party data that may be incomplete, out of date, or wrong. Real estate is local and cyclical, and results will vary. Market figures reflect a stated point in time and are summarized from public sources. We do not warrant that any number, grade, projection, or report is accurate, current, or suitable for your situation. You are solely responsible for your own decisions and for confirming all inputs and results.
The Tools are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Tools will be uninterrupted, error-free, or free of harmful components.
To the fullest extent allowed by law, DealGauge and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost investment, or lost data, arising from your use of the Tools. Our total liability for any claim relating to the Tools or a product will not exceed the amount you actually paid for that product. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Paid products come with a 30-day money-back guarantee on every channel we sell through, and you keep any files you have already downloaded. If you bought through Gumroad, request the refund through Gumroad. If you bought through Etsy, where digital downloads are generally not returnable through the platform, email [email protected] or message us on Etsy within 30 days with your order number and we will issue the refund manually to your original payment method within 10 business days. This guarantee is offered by us directly and is in addition to any rights the platform gives you.
Known issues and defects. We do not sell a paid file while we are aware of a defect in it. Any defect we know about is disclosed on our methodology page, and you can ask us at any time what we currently know to be wrong. Your remedy if we get something wrong. If we find a defect, we fix it and you receive the corrected file free, because updates are free forever. That corrected file is your sole and exclusive remedy outside the 30-day guarantee above. If we cannot fix it, or if you bought within the last 30 days, you may have a refund instead, at your choice. In every case our total liability is capped at what you actually paid for the product, as set out in section 4. We do not refund purchases made outside the guarantee window on the basis of a defect that has been corrected. Nothing in these terms limits our liability for fraud, fraudulent misrepresentation, or any liability that cannot be limited under applicable law.
If you are a consumer in the EU or UK, you normally have a 14-day right to withdraw from a purchase of digital content. Because our products are delivered instantly as a download, you will be asked at checkout to consent to immediate delivery and to acknowledge that you lose that 14-day withdrawal right. Where that consent is not given, the 14-day right is unaffected. Our 30-day guarantee above applies either way and is more generous.
The letter grade, the walk-away price and every other output are informational screening estimates produced solely from figures you enter. You agree that you will not treat any output as a recommendation to buy, decline, price or finance any property, that you will independently verify all figures, and that you will obtain professional advice before acting. You accept the entire risk of any decision you make after using the Tools, including a decision not to proceed with a transaction.
When you buy a product, you get a personal, non-exclusive, non-transferable license to use it for your own investing. The Tools, including their design, formulas, text, and layout, are owned by DealGauge and protected by law. You may not resell, redistribute, sublicense, publish, or repackage the Tools, or share paid files publicly, without written permission. Using the outputs for your own deals is fine and encouraged.
You agree not to misuse the Tools, including by attempting to breach security, scrape or bulk-copy content, reverse engineer paid files to resell them, or use the Tools for anything unlawful. We may suspend access for misuse.
Purchases and downloads are handled by Gumroad and by Etsy, and email by Kit, each under its own terms and privacy policy. How we handle your own data is described in our Privacy Policy. Market reports reference public third-party data. We are not responsible for third-party services or the sources they draw on.
We may update these terms from time to time. Changes take effect when posted, and the "last updated" date will change. Continuing to use the Tools after a change means you accept the updated terms.
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Illinois. Nothing in these terms deprives a consumer of the protection of the mandatory law of their country of residence. If any part of these terms is found unenforceable, the rest stays in effect.
